1. About Chay88 Creative Studio

Chay88 Creative Studio ("Chay88," "we," "us," or "our") is an independent creative brand rooted in South Asian diaspora culture, offering bold typographic products including ceramic mugs, printable art, journals, linens, and enamel pins. Our store is operated through Shopify and is available at chay88.com.

By visiting our site or purchasing from us, you engage in our "Services" and agree to be bound by these Terms of Service, including any additional terms, conditions, and policies referenced or linked here.

2. Eligibility

By agreeing to these Terms of Service, you confirm that you are at least the age of majority in your province, territory, or country of residence, and that you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorised purpose, and you must not violate any laws in your jurisdiction by using our Services.

3. Products and Availability

We reserve the right to limit the sale of our products or Services to any person, geographic region, or jurisdiction at any time. Product descriptions, images, and pricing are subject to change without notice. We have made every effort to display the colours and images of our products as accurately as possible, however we cannot guarantee that your device's display will accurately reflect the true colour of the products.

Print-on-demand products — items including our ceramic mugs are made to order and produced by a third-party print partner. Slight variations in colour, tone, or finish may occur between orders due to the nature of the printing process. These variations fall within acceptable tolerance and do not constitute a defect.

Directly shipped products — certain items are shipped directly by Chay88. These will be clearly indicated on the relevant product page.

Digital products — any downloadable or printable files are delivered electronically. All digital sales are final. No refunds will be issued for digital products once they have been accessed or downloaded.

We reserve the right to discontinue any product at any time. Prices for all products are subject to change without notice and are displayed in Canadian Dollars (CAD) unless otherwise stated.

4. Orders and Payment

When you place an order through chay88.com, you are making an offer to purchase the product(s) listed. We reserve the right to refuse or cancel any order at our discretion, including orders that appear to be placed by resellers or distributors, orders where pricing errors have occurred, or orders flagged for potential fraud.

You agree to provide current, complete, and accurate purchase and account information. You agree to promptly update your account and payment information so that we can complete your transactions and contact you as needed.

Payment must be received in full before your order is processed and dispatched. We accept the payment methods listed at checkout. By submitting payment information, you confirm that you are authorised to use the payment method provided.

5. Pricing and Taxes

All prices are listed in Canadian Dollars (CAD) and are exclusive of applicable taxes unless otherwise stated. Taxes will be calculated and displayed at checkout based on your shipping address and applicable law. You are responsible for any customs duties, import taxes, or additional charges that may apply to international orders. These charges are outside our control and are not included in your order total.

6. Shipping and Delivery

We ship to Canada, the United States, and select international destinations. Estimated delivery timeframes are provided at checkout and are estimates only — we cannot guarantee delivery dates and are not responsible for delays caused by carriers, customs, or circumstances outside our control.

Risk of loss and title for all products pass to you upon delivery to the carrier. For full details on shipping, please refer to our Shipping Policy.

7. Returns, Refunds, and Exchanges

Our Returns and Refunds Policy forms part of these Terms of Service and is incorporated here by reference. Please review it in full before placing an order.

In summary:

  • Print-on-demand products are made to order and cannot be returned for change of mind. Defective, damaged, or incorrect items will be replaced or refunded at no cost to you when reported within the applicable timeframe.
  • Directly shipped products may be returned within 30 days of delivery, unused and in original packaging, subject to the terms in our Returns Policy.
  • Digital products are non-refundable once accessed or downloaded.
  • Sale items are final sale and non-returnable.

8. Intellectual Property

All content on chay88.com, including but not limited to typographic designs, product artwork, logos, text, images, graphics, and brand identity, is the intellectual property of Chay88 Creative Studio and is protected by applicable copyright and trademark laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any of our content without our prior written consent. Personal, non-commercial use of our website content is permitted provided you do not modify the materials and keep all copyright and proprietary notices intact.

Purchasing a product does not transfer any intellectual property rights to you. You are purchasing a physical or digital item — not the underlying design, trademark, or brand identity.

9. User Conduct

You agree not to use our Services to:

  • Violate any applicable local, national, or international law or regulation
  • Transmit any unsolicited or unauthorised advertising or promotional material

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites.
